Welcome to ROVR. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Peach Family Brands ("Company," "we," "us," or "our"), a company based in Adairsville, Georgia, United States, governing your access to and use of the ROVR mobile application ("App" or "ROVR"), including all related features, content, and services.
By downloading, accessing, or using ROVR, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. We encourage you to read these Terms carefully before using ROVR.
By creating an account, accessing, or using any part of the ROVR application, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy, all of which are incorporated herein by reference. If you are using ROVR on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
We reserve the right to modify these Terms at any time. Changes will be posted within the App and, where material, communicated via email or in-app notification. Your continued use of ROVR after such changes constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.
You must be at least eighteen (18) years of age to create an account and use ROVR. By using the App, you represent and warrant that you are at least 18 years old. We do not knowingly collect information from or provide services to individuals under 18.
To participate in any drive or route activity on ROVR as a driver, you must hold a valid driver's license issued by a recognized governmental authority in the jurisdiction where the drive takes place. By joining a drive as a driver, you represent and warrant that you possess a valid driver's license and that your license has not been suspended or revoked.
To use ROVR, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that contain false or misleading information.
Each individual may maintain only one ROVR account. Creating multiple accounts for the purpose of evading bans, manipulating features, or any other deceptive purpose is prohibited and grounds for permanent termination of all associated accounts.
ROVR is a social platform for automotive enthusiasts and driving club communities. The App provides the following features and functionality:
You agree to obey all applicable federal, state, and local traffic laws, regulations, and ordinances at all times while participating in any ROVR drive or event. This includes, but is not limited to, posted speed limits, traffic signals, right-of-way rules, and laws governing the operation of motor vehicles in your jurisdiction.
You agree to drive within your personal skill level, experience, and comfort zone at all times. You will not operate your vehicle beyond your capabilities, regardless of the actions of other drive participants. You understand that no ROVR drive, club, or event organizer has the authority to instruct you to drive in an unsafe or illegal manner, and you are under no obligation to follow any such instruction.
You agree not to interact with the ROVR app or any device while operating a motor vehicle. All app interaction, including viewing maps, sending messages, and managing voice chat, must be performed by a passenger or while the vehicle is safely parked and not in active traffic. You acknowledge that distracted driving is illegal in many jurisdictions and inherently dangerous.
You are solely responsible for ensuring that your vehicle is in safe operating condition before and during any drive. This includes, but is not limited to, adequate tire condition, functioning brakes, working lights, and sufficient fuel. ROVR does not inspect, certify, or guarantee the condition of any participant's vehicle.
By participating in any drive, route, event, or other activity organized through or facilitated by ROVR, you voluntarily assume all risks associated with such participation, including but not limited to risks of property damage, personal injury, disability, and death. You acknowledge that these risks may arise from your own actions, the actions of other participants, road conditions, weather, vehicle malfunction, or other causes. This assumption of risk applies whether or not such risks are foreseeable.
ROVR, Peach Family Brands, and their respective officers, directors, employees, agents, and affiliates are not liable for any accidents, injuries, deaths, property damage, traffic violations, vehicle impoundment, or any other loss or harm arising out of or related to your participation in any drive, route, event, or other activity facilitated through the App. This limitation applies regardless of whether such harm results from negligence, defective routes, inaccurate directions, GPS errors, app malfunctions, or any other cause.
When you join and participate in a group drive, ROVR collects and shares your real-time GPS location with other participants in that drive. By joining a drive, you expressly consent to this collection and sharing of your location data for the duration of the drive.
Your location data during drives is used to provide the group drive experience, including displaying participant positions on the map and enabling route tracking. Location data is collected only during active drives and is not continuously tracked while the App is in passive use. Location data from completed drives may be retained to provide drive history features within your account. You may request deletion of your drive history data as described in our Privacy Policy.
You retain ownership of all content you create and post through ROVR, including but not limited to photos, text posts, messages, routes, club descriptions, and event listings ("User Content"). By posting User Content on ROVR, you grant Peach Family Brands a non-exclusive, royalty-free, worldwide, transferable, sub-licensable license to use, reproduce, modify, display, distribute, and create derivative works of your User Content solely for the purpose of operating, improving, and promoting the ROVR platform.
You are solely responsible for all User Content you post, upload, or share through ROVR. You represent and warrant that you own or have the necessary rights and permissions to post your User Content and that your User Content does not violate any third party's rights, including intellectual property, privacy, or publicity rights.
We reserve the right, but are not obligated, to review, monitor, edit, or remove any User Content at our sole discretion, for any reason or no reason, including but not limited to content that we believe violates these Terms, our Acceptable Use Policy, or applicable law. We are not responsible for any User Content posted by users.
If you believe that any User Content on ROVR infringes your rights, please contact us at cal@peachfamilybrands.com with a detailed description of the alleged infringement. We will review all legitimate complaints and take appropriate action.
Users who create clubs on ROVR ("Club Owners") are responsible for the management, conduct, and content of their clubs. Club Owners are responsible for ensuring that club activities comply with these Terms, the Acceptable Use Policy, and all applicable laws. ROVR provides the platform but does not supervise, endorse, or assume liability for any club's activities.
Users who create events ("Event Organizers") are solely responsible for the planning, execution, safety, and legal compliance of their events. This includes obtaining any necessary permits, insurance, or other requirements. ROVR is not the organizer, co-organizer, or sponsor of any user-created event unless explicitly stated otherwise. Event Organizers agree to indemnify and hold harmless Peach Family Brands from any claims arising out of their events.
ROVR facilitates payment processing for paid events through our third-party payment processor, Stripe. When you purchase a ticket to a paid event, your payment is processed on behalf of the Event Organizer. ROVR acts solely as a payment facilitator and is not responsible for the event itself, including its quality, safety, cancellation, or any disputes between attendees and organizers. Refund policies for paid events are set by the Event Organizer. ROVR may charge a service fee on paid event transactions, which will be disclosed at the time of purchase.
ROVR provides a voice chat feature for communication among drive participants during active drives. By using voice chat, you agree to communicate respectfully and in compliance with our Acceptable Use Policy.
ROVR does not record voice chat conversations. Voice communications are transmitted in real time between participants and are not stored on our servers. However, we cannot prevent other participants from recording conversations using their own devices. You use voice chat with the understanding that other participants may independently choose to record.
You agree not to use voice chat to harass, threaten, or intimidate other users, or to share illegal, obscene, or harmful content. Violations may result in the suspension or termination of your account.
The ROVR application, including its design, features, code, graphics, logos, trademarks, and all other intellectual property associated with the App and Peach Family Brands, are owned by or licensed to Peach Family Brands and are protected by United States and international intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on any part of the ROVR application without our prior written consent.
"ROVR," "Peach Family Brands," and all associated logos and marks are trademarks of Peach Family Brands. You may not use these trademarks without our prior written permission, except as reasonably necessary to refer to ROVR or Peach Family Brands in a descriptive context.
If you provide us with any feedback, suggestions, or ideas regarding ROVR ("Feedback"), you grant us an unrestricted, irrevocable, perpetual, royalty-free license to use, modify, and incorporate such Feedback into the App or our services without any obligation to you.
You may delete your account at any time through the App's settings or by contacting us at cal@peachfamilybrands.com. Upon deletion, your profile, club memberships, and associated data will be removed in accordance with our Privacy Policy.
We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for any reason, including but not limited to:
Upon termination of your account, your right to use ROVR ceases immediately. We may, but are not obligated to, delete your User Content. Provisions of these Terms that by their nature should survive termination will survive, including but not limited to Sections 4 (Driving Safety), 6.1 (Content License), 11 (Limitation of Liability), 12 (Indemnification), and 13 (Dispute Resolution).
ROVR IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PEACH FAMILY BRANDS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ROVR WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY OR RELIABILITY OF ANY ROUTE, MAP, DIRECTION, OR NAVIGATION INFORMATION PROVIDED THROUGH THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEACH FAMILY BRANDS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, BODILY INJURY, DEATH, PROPERTY DAMAGE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE ROVR, ANY DRIVE, ROUTE, EVENT, OR OTHER ACTIVITY FACILITATED THROUGH THE APP, OR ANY CONTENT OR CONDUCT OF THIRD PARTIES ON THE APP, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF PEACH FAMILY BRANDS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF PEACH FAMILY BRANDS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF ROVR SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PEACH FAMILY BRANDS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, the above limitations and exclusions may not apply to you in full, and our liability will be limited to the maximum extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless Peach Family Brands, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
This indemnification obligation will survive the termination of your account and these Terms.
These Terms and any disputes arising out of or related to these Terms or your use of ROVR shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
You and Peach Family Brands agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or your use of ROVR (collectively, "Disputes"), shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring individual claims in small claims court if they qualify.
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator. The arbitration shall take place in Bartow County, Georgia, or at another mutually agreed-upon location. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND PEACH FAMILY BRANDS AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.
Before initiating arbitration, you agree to first attempt to resolve any Dispute informally by contacting us at cal@peachfamilybrands.com. We will attempt to resolve the Dispute informally within sixty (60) days. If the Dispute is not resolved within that period, either party may proceed to arbitration.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the infringement or misappropriation of intellectual property rights.
ROVR integrates with and may contain links to third-party services, websites, and applications. These include, but are not limited to, Clerk (authentication), Mapbox (mapping and navigation), Amazon Web Services (media storage), Firebase (push notifications), and Stripe (payment processing). Your use of these third-party services is subject to their respective terms of service and privacy policies. Peach Family Brands is not responsible for and does not endorse the content, accuracy, or practices of any third-party services.
We reserve the right to modify, suspend, or discontinue any part of ROVR at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service. We may also update the App from time to time, and you may need to download updates to continue using certain features.
These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Peach Family Brands with respect to your use of ROVR and supersede all prior or contemporaneous communications, whether oral or written, regarding the subject matter herein.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
The failure of Peach Family Brands to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by Peach Family Brands.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Peach Family Brands may assign its rights and obligations under these Terms without restriction.
Peach Family Brands shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, or failures of third-party services.
